1. Reason for revision
With the establishment of Article 19.2 of the Green Buildings Construction Support Act, the aim is to establish the legal system and secure the predictability of administrative actions by providing detailed standards and procedures, etc. for the cancellation of designation and suspension of business of building energy efficiency rating certification agencies and zero energy building certification agencies delegated to the Minister of Land, Infrastructure and Transport and Minister of Trade, Industry and Energy.
2. Main contents
A. Prohibition of re-designation of certification agencies whose certification had been canceled (Article 4 and Form 1 of the Draft)
The aim is to add the items to be checked by the Minister of Land, Infrastructure and Transport for designation of certification agencies in order to prevent re-designation of certification agencies that have a history of cancellation of certification in accordance with Article 19.1 of the Act.
B. Preparation of standards and procedures for administrative dispositions (Article 5-2 of the Draft)
The aim is to establish legal systems and secure the predictability of administrative dispositions by providing standards and procedures for administrative dispositions delegated in accordance with Article 19.2 of the Act.
C. Preparation of detailed standards on administrative dispositions (Table 3 of the Draft)
The aim is to secure the predictability of administrative dispositions by classifying matters for cancellation of certification and for suspension of business into general standards and individual standards and by providing the standards on dispositions by times of violations.
D. Update of citing provisions (Article 1, Article 3, and Article 5 of the Act)
The aim is to add matters delegated by the ministerial decree in the provision of purpose of this Rule pursuant to the revised Act and to update citing provisions in the ministerial decree as per Article 19 of the Act.
