1. Reason for proposal
With the amendment of “Protection of Nuclear Facilities, etc. and Radiation Disaster Prevention Measures Act” (Act No. 18238, promulgation on June 8, 2021, planned enforcement on December 9, 2021) to establish residence protection & support centers under the Minister of Public Administration and Security and clarify the legal basis for the collection of charges for the effective protection of residents, the aim is to decide the matters delegated by laws and matters needed for execution thereof.
2 Main content
A. Matters needed for the configuration and operation of joint public information center, joint radiation monitoring center, joint radiological emergency medical institution, and citizen protection and support center to be installed upon the occurrence of radiological disaster, etc. are prescribed (Article 31, Article 32-2, and Appendix Table 3 of the draft).
B. Matters on the designation of and withdrawal thereof of radiological disaster prevention education institutions and designation of radiological emergency medical institution are prescribed (Article 33-2, Article 33-3, Article 36, and Article 36-2 of the draft).
C. Matters needed for the Atomic Safety Commission and the Ministry of Public Administration and Security to evaluate jointly the radiological disaster prevention training to be provided by local governments are prescribed (Article 35 of the draft).
D. As the previously collected atomic safety control charges are defined as charges under the Framework Act on the Management of Charges, the provisions on the basis of delegation and terms including previous calculation standard, payment method, payment time, etc. are changed (Article 40-2, Article 40-3, and Appendix Table 4-2 of the draft).
E. Correction of basis of delegation and other matters including correction of letters/phrases (Article 7, Article 26, and Article 40).
