1. Reason for proposal
It is intended to supplement and improve some insufficiencies found in the operation of the current system by allowing up to two (2)-year period for the return of inspection-omitted containers to be imported to import high-pressure gases in order to promote industries importing and using pressure gases such as the semiconductor industry and reduce the burden of related business, by preparing the basis of requesting costs to persons who intend to undergo factory inspection for the registration and re-registration of manufacture of foreign hydrogen products, and by providing specialized and tailored safety manager cultivation education for the specialization of safety management for hydrogen refueling stations that are rapidly being expanded.
2. Main content
A. Preparation of condition to extend the return period of inspection-omitted imported containers (Article 15(1)8 of the draft)
Inspection is omitted for the containers to be imported to meet the acceptance standard notified by the Minister of Trade, Industry, and Energy; in case of containers for special uses that satisfy the notified standard, up to two (2)-year return period is allowed.
B. Preparation of basis to request costs to the persons intending to undergo factory inspection for registration and re-registration of manufacture of foreign hydrogen products (Subparagraph 2 of Article 22 of the draft)
With the establishment of the Act on Hydrogen Economy Development and Hydrogen Safety Control, Korea Gas Safety Corporation shall prepare the provisions to request factory inspection costs for the registration and re-registration of manufacture to foreign hydrogen product manufacturers.
C. Preparation of basis to request costs to the persons intending to be confirmed for omission of inspections of containers, etc. (Subparagraph 3 of Article 22 of the draft)
Korea Gas Safety Corporation shall prepare provisions to request costs to the persons intending to be confirmed for omission of inspections of containers, etc.
D. Establishment of the course on tailored safety manager cultivation education for hydrogen refueling stations (Attached Table 3 of the draft)
Safety management is specialized with the establishment of safety manager cultivation education course specialized for hydrogen refueling stations, and safety management manpower is increased with the qualification of education-completing persons as safety managers of refueling stations.
E. Clarification of standard on the accumulated number of violations with regard to fine for negligence (Subparagraph 1 (c) proviso of Attached Table 4 of the draft)
As the interpretation and execution of application of accumulated number of violations differ by agency when imposing a fine for negligence, the standard on accumulated number of violations is clarified to protect civil rights and interests.
F. The amount of fine for negligence is prescribed depending on the number of violations in case confirmation of observance of safety management regulation is refused, hindered, or avoided (Subparagraph 2 (n) of Attached Table 4).
