Reasons for Proposal

As Internet security technologies are becoming more advanced, cybercrime information is also being circulated through increasingly various channels. Information on various crimes including child sexual abuse, hacking, drug dealing, gambling, and terrorism is being circulated through the dark web, which cannot be accessed through standard Internet pathways.

Unlike the surface web, which is easily accessible by the general public, the dark web makes it difficult to track servers and also poses difficulties in blocking cybercrime information within the dark web and investigating persons who have circulated such information due to measures taken to anonymize and encrypt users of dark web sites. This has resulted in growing demands for stronger regulations over these matters.

Accordingly, the Amendment adds to the scope of unlawful information prohibited from circulation under this Act any information enabling access to websites that cannot be accessed by users through standard search methods but that provide unwholesome information for juvenile or information on hacking, drug dealing, gambling, terrorism, etc., thereby aiming to contribute to the development of an environment in which information and communications services are used in a healthier and safer manner (Article 44-7, paragraph 1, subparagraph 9 newly inserted, etc.).

Major Provisions

Prohibit the circulation of any information enabling access to websites that cannot be accessed by users through standard search methods but that provide unwholesome information for juveniles or information on hacking, drug dealing, gambling, terrorism, etc. (Article 44-7, paragraph 1, subparagraph 9).
