Reasons for Proposal

The current Act has a provision that bans inappropriate business entities from participating in national tenders within 2 years as a penalty for inappropriate business entities.

To prevent industrial accidents, which have continued to occur recently, it is needed to ban tender participation for business entities that violate obligations to ensure safety and health under the Act on Punishment for Serious Accidents, etc., which is to be enforced from January 2022, and business entities that violate measures to ensure safety and health under the Occupational Safety and Health Act as currently defined in the Enforcement Decree.

In this regard, this Act aims to specify business entities that violate obligations to ensure safety and health under the Act on Punishment for Serious Accidents, etc. and business entities that violate measures to ensure safety and health under the Occupational Safety and Health Act as reasons for becoming inappropriate business entities banned from participating in tenders (Article 27, paragraph 1, subparagraphs 7-2 and 7-3 newly inserted).
