Reasons for Proposal

With recent advances in autonomous driving technology, there are increasing numbers of vehicles equipped with cutting-edge steering systems that support drivers by detecting distance and speed with vehicles ahead, keeping lanes, and automatically driving or steering with sensors and cameras installed in front of the vehicle (“driver assistance cutting-edge steering systems”).

The current Act requires a vehicle with a driver assistance cutting-edge steering system of Level 2 in autonomous driving to send a warning if the driver does not keep his or her hands on the steering wheel with visual or auditory signals since it is not fully autonomous.

However, some drivers put a weight at the back of the steering wheel or install a module to illegally manipulate warning signals to not go off, which leads to negligence in maintaining road awareness and increases the risk of traffic accidents. However, there is no basis to crack down on such installed devices and manipulation.

In this regard, this Act aims to specify driver assistance cutting-edge steering systems in addition to maximum speed limiters as prohibited systems in the provision Prohibition on Unauthorized Dismantlement or Manipulation of Motor Vehicles and imposes up to 3 years in prison or 30 million won in fines for any violation thereof in an effort to reduce the risk of traffic accidents due to illegal manipulation and raise awareness among drivers about autonomous driving levels (Article 35 and Article 79 subparagraph 5-2).
