Reasons for Proposal

The current Act stipulates that parts and devices (seat belts, etc.) that are installed or used in motor vehicles must meet the performance and standards required for safe operation, but seat belt buckle alarm stoppers, etc., are distributed and sold on the market to encourage drivers and passengers not to fasten seat belts, which poses a threat to the safe operation of motor vehicles, so it has been pointed out that countermeasures need to be prepared.

In particular, although the Korea Consumer Agency has recommended not to continue the sales of “seat belt buckle alarm stoppers” in February 2017, it has been difficult to crack down on such products because there was no legal basis to regulate products and services that threaten safe operation.

Therefore, this amendment aims to prohibit the manufacture, distribution, or sale of “products hindering safety performance” that impair the performance of the structures and devices required for safe operation prescribed by the Ordinance of the Ministry of Land, Infrastructure and Transport. This also aims that violators of the above provision shall be subject to punishment by imprisonment of up to 1 year or a fine not exceeding 10 million won (Article 29 (5) and Article 81 subparagraph 8-2 newly inserted).
