(Background) 

The Act on the Safety Control of Hazardous Substances of Korea described liquids with a flash point of 250 degrees or less as hazardous substances, so most cosmetic products and quasi-drugs were classified as hazardous substances. 

This was a very strict regulation compared to the US and the UN, where flammable liquids are specified as those whose flash points are 93 degrees or less, and Europe with 60 degrees or less. 

The EU's regulations concerning the classification, marking, and packaging of hazardous substances excludes finished cosmetic products and pharmaceutical products from its scope. 


(Grievance) 

Non-hazardous substances were classified as hazardous when they are imported to Korea, so storing or distributing the products pursuant to the regulation was unfair when the risk of cosmetic products is considered. 

Resoultion and Results

(Resolution)

Finished products of cosmetic products and quasi-drug products are excluded from application following the amendment of the Enforcement Decree of the Act on the Safety Control of Hazardous Substances → The Enforcement Decree of the Act on the Safety Control of Hazardous Substances was partially amended on February 26, 2019 (Presidential Decree No. 29564)


(Result)

Introduce global standards for storing and distributing finished cosmetic products and quasi-drug products.
