1. Reasons for Amendment


This Partial Amendment aims to expand support eligibility for a joint project with the private sector, etc. to include vocational training institutions, improve personnel and physical requirements for fee-charging job placement services, prepare matters to be observed by the person running business providing employment information in line with a changing market to promote the private sector employment service market, clarify criteria to impose administrative fines, and improve and supplement a number of shortcomings in the operation of the current system.



2. Major Provisions


A. Expand support eligibility for a joint project with the private sector, etc. (Article 2-3)

Add vocational skill development training entities to institutions eligible to conduct a joint (or entrusted) project with the state to provide quality employment services to job seekers by strengthening collaboration with vocational training institutions


B. Improve registration requirements, etc. for fee-charging job placement services (Article 21 and Article 34-2)


1) Accept requirements less directly related to job placement and counseling, including those dedicated to labor union tasks, those with experience as a public servant, those with a teaching certificate, and those with a social worker certificate, among registration requirements for fee-charging job placement services only for those with at least 2 years of counseling related to job placement in an effort to rationalize personnel requirements

 - Change requirements to be met by officers among the entity’s registration requirements for fee-charging job placement services from 2 persons to 1 person 


2) Define a deposit of 50 million won for those who intend to do job placement services without an office 



C. Improve matters to be observed by the person running business providing employment information (Article 28)

 Specify personal information protection obligations for job seekers by reflecting a changing private sector employment service market, including expanding online business providing employment information, delete a ban on the use of the phrase “employment recommendation,” and improve matters to be observed by the person running a business providing employment information


D. Improve criteria for imposing administrative fines (Table)

 Improve people’s predictability for the imposition of administrative fines by clarifying added points to calculate the number of violations and criteria to apply the ordinal number of a violation when administrative fines are imposed on the person running business for repeated violations during a certain period
