1. Reasons for Enactment


As the Act on Promotion of Cooperation in Local Farming, Forestry, and Fisheries Development Projects was enacted (Act No. 19120; enacted on December 27, 2022, and enforced on December 28, 2023) to improve the income and welfare of local farmers, foresters, and fishermen, improve the economic and social benefits of local residents, and contribute to the development of the local economy through public-private cooperation, this Enforcement Decree of the Act aims to prescribe matters delegated by the Act and matters necessary for its implementation, such as the scope of private operating institutions that will promote local agriculture, forestry, and fisheries development projects, private institutions eligible for proposing projects, reasons necessary for the termination of or changes to agreements, disclosure of the promotion status of local agriculture, forestry, and fisheries development projects, and detailed standards for the imposition/collection of administrative fines.




2. Major Provisions


A. Specify the scope of eligible private operating institutions (Article 2)


ㅇ (Major Provision) Specify the scope of agricultural and fishing corporations, agricultural, forestry and fishery-related cooperatives, social cooperatives, social enterprises, micro-enterprises, and small and medium-sized enterprises that will be eligible for private operating institutions as each corporation, etc., that conducts business using tangible and intangible agricultural, forestry, and fishery resources such as agricultural and marine products, nature, and culture.


ㅇ (Reasons for Enactment) Necessary to specify them as a corporation, etc. that conducts business related to agricultural, forestry, and fishery resources such as agricultural and marine products, nature, and culture because they are the driving force behind local agricultural, forestry, and fishery development projects.



B. Specify details on targets such as private organizations that can propose local agriculture, forestry, and fisheries development projects (Article 3)


ㅇ Specify the following private organizations that can propose local agriculture, forestry, and fisheries development projects as eligible institutions: operating institutions that can be the driving force behind the project, non-profit private organizations that conduct business using tangible and intangible agricultural, forestry, and fishery resources such as agricultural and marine products, nature, and culture, and non-profit corporations under the Ministry of Agriculture, Food and Rural Affairs and the Ministry of Oceans and Fisheries.


ㅇ The need to promote projects such as solving local agricultural, forestry, and fishery problems, increasing the income of farmers, foresters, and fishermen, and revitalizing the economy of rural, forestry, and fishing villages can be easily identified by corporations or organizations related to agriculture, forestry, and fisheries, so select those proposed private institutions as targets.



C. Specify in detail the reasons for the termination of or changes to agreements (Article 4)


ㅇ In addition to the reasons for the termination of or changes to agreements set forth in Article 9 (1) 1 through 4 of the Act, determine the following cases as other reasons for the termination of or changes to agreements: ①reasons such as the cancellation of business/sales license, suspension of business, closure of business, etc., ② where the local government head does not respond to the request for the supplementation of the implementation plan, ③ where it is impossible or no longer necessary to proceed with all or part of a project after the conclusion of the agreement due to a natural disaster or other unavoidable reasons, or ④ where it is recognized that it is difficult to achieve performances through a project inspection and interim evaluation. 


ㅇ In addition to the reasons prescribed by the Act, additionally prescribe other reasons for the termination of and changes to agreements.



D. Prescribe details on the disclosure of the promotion status of local agriculture, forestry, and fisheries development projects (Article 5)


ㅇ The promotion status of local agriculture, forestry, and fisheries development projects shall be disclosed by project, and the items to be disclosed shall include the project name, project target, project period, name of the private operating organization, project details, and other matters deemed necessary by the head of the local government to be disclosed.


ㅇ The items to be disclosed on the promotion status of local agriculture, forestry, and fisheries development projects have been set to those that need to be disclosed to the residents.



E. Detailed standards for imposing administrative fines (Article 6)


ㅇ Set the amount of administrative fines in detail (1.5 million to 3 million won) depending on the number of violations (1st to 3rd) for each reason for imposing administrative fines as stipulated in Article 14 of the Act.


ㅇ Article 14 of the Act stipulates that an administrative fine of not more than three million won shall be imposed for the relevant violation, so there is a need to set different administrative fines depending on the number of violations and the severity of each violation. Establish detailed standards for administrative fines.
