1. Reasons for Amendment
The Harbor Transport Business Act was amended (Act No. 19501; partially amended on June 20, 2023; to be enforced on December 21, 2023) to newly insert comprehensive harbor service businesses and streamline the management authority for weighing businesses and appraising businesses. Accordingly, this Amendment prescribes registration criteria and administrative disposition criteria for comprehensive harbor service businesses and stipulates other matters delegated by the Act and matters necessary for the enforcement thereof. It also amends registration and reporting criteria for harbor transport businesses and harbor transport-related businesses that have not been amended for a long time to better account for the current circumstances of harbor operation, etc.
2. Major Provisions
A. Prescribe registration criteria for comprehensive harbor service businesses (Article 4, attached Table 3)
Prescribe registration criteria (capital, staff, etc.) for the newly inserted category of comprehensive harbor service businesses.
B. Prescribe administrative disposition criteria for comprehensive harbor service businesses (Article 11, attached Table 5)
Prescribe criteria on administrative dispositions (suspension of business, revocation of registration) for the newly inserted category of comprehensive harbor service businesses.
C. Modify provisions on the delegation of authority (Article 27)
Based on amendments to the Act to streamline the management authority for weighing businesses and appraisal businesses from the Minister of Oceans and Fisheries to the Administrators of Regional Offices of Oceans and Fisheries and Mayors/Do Governors, delegate the authority of the Minister of Oceans and Fisheries regarding the registration, etc. of weighing businesses and appraisal businesses to the Administrators of Regional Offices of Oceans and Fisheries, and delegate the authority of the Minister of Oceans and Fisheries regarding the registration, etc. of the newly inserted comprehensive harbor service businesses to the Administrators of Regional Offices of Oceans and Fisheries.
D. Amend registration and reporting criteria for harbor transport businesses and harbor transport-related businesses (attached Tables 1, 2, and 6)
Amend registration and reporting criteria for harbor transport businesses and harbor transport-related businesses that have not been amended for a long time to better account for the current circumstances of harbor operation, etc.
