1. Reasons for Amendment

The Game Industry Promotion Act was amended (to be enforced on March 22, 2024) to require indication of the types of probabilistic items and information on the probability of obtaining each type of item. Accordingly, this Amendment prescribes the scope of game products subject to compulsory indication of probabilistic items, method of indication, and other matters delegated by the Act and matters necessary for the enforcement thereof.


It also protects game users from the absence of probability information and false indications of probability, etc. through the transparent disclosure of information on probabilistic items, and prescribes grounds to develop an environment of fair game use. 




2. Major Provisions


A. Prescribe matters to be indicated for probabilistic items and the scope of game products subject to compulsory indication (Article 19)


1) Prescribe matters to be indicated, such as probability information, for each main type of probabilistic items including capsules, upgrades, and composites.


2) Prescribe that where a probabilistic item is limited in quantity or only available for a limited time, the corresponding information shall be indicated.


3) Prescribe that when “the outcome of each purchase, unboxing, upgrade, merge, or other trial according to the probabilities applicable to probabilistic items affects the outcomes of other trials” or when “there is a 100% chance of obtaining a game item after meeting certain conditions such as purchasing, unboxing, upgrading, merging, or otherwise using probabilistic items a certain number of times,” probability information on the relevant method shall be indicated.


4) Prescribe that game products subject to compulsory indication shall be “game products that offer probabilistic items,” but shall not include arcade game rooms, game products excluded from rating classification, small game companies, etc.



B. Newly insert provisions on indicating information on probabilistic items (attached Table 3)


1) Prescribe that information on probabilistic items shall be easily identifiable by users and shown as percentages as a general rule, and that an announcement shall be made in advance when the information is modified.


2) Prescribe methods for indicating information in probabilistic items to account for the nature of different media subject to compulsory indication such as game products, websites, advertisements, and promotional materials.
