1. Reasons for Amendment
The “Outdoor Advertisements Act” was amended (June 10, 2022) and enforced (December 11, 2022) to guarantee freedom of political party activities by prescribing that political party placards shall not be subject to permission, reporting, prohibition, or restriction. However, the lack of restrictions on the number, size, etc. of political party placards has resulted in public inconvenience, safety accidents, disruption to the city landscape, environmental pollution, and other adverse effects since the enforcement of the Act.
As a result, the “Outdoor Advertisements Act” was amended (approved by the Public Administration and Security Committee on November 1, 2023; to be enforced on January 1, 2024) prescribe a maximum limit of 2 political party placards per eup/myeon/dong area, and to delegate display/installation methods concerning the location, size, of political party placards to the Enforcement Decree. Accordingly, this Amendment specifies in the Decree matters that have been delegated by the Act, thereby aiming to protect the safety and living environment of the people.
2. Major Provisions
A. Prescribe display/installation methods concerning the location, size, etc. of political party placards (Article 35-2)
1) The previous Decree was only delegated to prescribe the display method (indication of the contact details of the political party and installation service, name of the political party, and display period) and period (up to 15 days) of political party placards.
2) This Amendment specifies display/installation methods in terms of other matters such as the location and size of political party placards as newly delegated by the amended “Outdoor Advertisements Act.”
(1) Prescribe locations where placard installation is prohibited as it would undermine the safety of pedestrians or means of transportation (children protection zones, areas near fire-fighting facilities).
(2) Prescribe dimensions for political party placards (up to 10㎡).
(3) Prescribe the method of indication of the display period and the minimum font size (5 cm in vertical height).
(4) Prescribe the installation method (a placard shall not cover any other placard, signal apparatus, or safety sign or traverse a road; no more than 2 placards shall be installed on any streetlight or utility pole; placards shall not be installed at a height less than 2.5 m near any intersection, pedestrian crossing, or bus station).
