1. Reason for revision
The Road Traffic Act was revised (Law No. 20270; promulgated on February 13, 2024; implemented on August 14, 2024) to revoke or suspend a driver's license when insurance fraud has been committed while using a motor vehicle etc. under the Special Act on Prevention of Insurance Fraud, and to add the history of sexual offenses to the grounds for revoking the qualifications of instructors and skills testers of automobile driving schools. The proposed revision provides the criteria for revoking or suspending the driver's license of those who have committed offenses under Articles 8 to 10 of the Special Act on Prevention of Insurance Fraud. The Road Traffic Act was further amended (Law No. 20375; promulgated on March 19, 2024; implemented on September 20, 2024) to provide the criteria for revoking or suspending the qualifications of instructors and skill testers, and to prohibit the lending, or arranging of lending, of driver's licenses, instructor's certificates, and skill testers' certificates for their unlawful use. The proposed amendment also provides the criteria for revoking or suspending a driver's license and revises the related provisions cited under the Enforcement Rules.
2. Main contents
a. It newly establishes administrative dispositions for revoking or suspending the driver's license of insurance fraudsters and lenders of driver's licenses for fraudulent use (Appendix 28 of the draft).
b. It adds reasons for disqualification of instructors and others at specialized driving academies, including sexual violence crimes and causing death or injury through dangerous driving, and revises the cited legal provisions.
