1. Reason for revision
In order to ensure the safe management, and rationalize the regulation, of high-rise buildings, which have become increasingly diverse in terms of their scale and form, the Special Act on Management of Disasters in Super High-Rise Buildings and Complex Buildings with Underground Connections has been revised (Law No. 20274; promulgated on February 13, 2024; implemented on February 14, 2025) to improve the system of advance review consultation on the impact of disasters into the “advance disaster impact assessment system” so as to provide the statutory grounds for designating a representative of the general disaster manager, the general disaster manager's request for action against the management entity of high-rise buildings, and the fire chief's ordering of actions, etc.
The proposed revision is designed to specify the matters delegated by the Act and the Enforcement Decree, and to correct or improve the terms based on the purposes of the revised Act, including the application form for reassessment of the impact of a disaster and the procedure and methods for ordering actions.
2. Main contents
a. The fire chief, etc. should notify the measures ordered in writing, specifying the details and the period. If the management entity is unable to fulfill the order within the given period due to a disaster or other unavoidable causes, it will be allowed to apply for an extension up to five days before the expiration of the period. An administrative agency that has received an application for an extension should decide its approval within three days (Article 10-2 of the draft).
b. It newly provides the application form for reassessment of the advance assessed disaster impact, and changes some forms, including the revision of the terms, to meet the purpose of the revision.
c. As the revised Act delegates the qualifications of general disaster managers and the procedure for the suspension of functions to be determined by the Enforcement Decree, the relevant provisions are to be deleted from the Enforcement Rules to be provided in the Enforcement Decree.
