1. Reason for enactment
The purpose of the proposed Enforcement Rules is to provide the matters delegated by the Special Act on National Resources Security enacted to respond effectively to crises related to resources security and the matters necessary for its enforcement (Law No. 20196; enacted on June 02, 2024).
2. Main contents
a. Notification of Designated Recycling Industry Clusters (Article 2 of the draft)
To designate a recycling industry cluster, it is mandatory to publish its name, location, and area, the purpose and date of its designation, and the period of its development in the Government Gazette.
b. De-designation of recycling industry clusters (Article 3 of the draft)
1) When a city mayor or provincial governor wishes to request changes in a plan for the creation of a recycling industry cluster, he/she shall submit documents that explain the details of and reason for such changes, and materials and drawings that can explain the details of such changes.
2) When a city mayor or provincial governor wishes to request the de-designation of a recycling industry cluster, he/she shall submit a document stating its name, location, and area, and the cause of or reason for such request.
c. Management of Resource Security Crisis Response Manual (Article 4 of the draft)
1) The Minister of Trade, Industry and Energy shall prepare a national crisis response manual that takes into account prevention, preparedness, response, and recovery measures for each type and stage of resource security crisis.
2) The head of a key supply institution shall prepare an institutional crisis response manual, including the command system and functions of its resource security crisis response organization.
