1. Reason for Enactment
Although a stable supply of electricity is a key element of national security, unlike other key industries there is no basic law for the electricity sector. Therefore, it is necessary to comprehensively regulate the matters required for the growth of the electricity industry and to organically link related individual laws in order to foster the electricity industry as a new growth engine.
Accordingly, as the Framework Act on Electricity Industry Development (Law No. 19956; enacted on January 9, 2024; effective from January 10, 2025) has been enacted to enhance the competitiveness of the electricity industry and to promote sustainable development, it is to enact the enforcement decree that stipulates the matters delegated by the Act and the matters necessary for its implementation.
2. Main Contents
A. It stipulates the scope of the electric industry and the matters regarding the celebration of Electricity Day (Articles 2 to 3 of the draft).
B. It stipulates the procedures, scope, schedules, etc. for establishing and promoting the basic plan for the development of the electricity industry and the implementation plan (Article 4 of the draft).
C. It stipulates the subject and the method of the on-site investigation of the electric industry (Article 5 of the draft).
D. It stipulates the matters necessary for the payment standards, use, and management of contributions or subsidies for research, development, and verification of electrical technology, and the related distribution projects (Article 6 of the draft).
E. It stipulates the specific matters regarding the designation, management, and support of institutions for training electrical industry professionals (Articles 7 to 10 of the draft).
F. It stipulates the scope of the institutions and organizations responsible for carrying out international cooperation in the electricity industry and promoting expansion into overseas markets, and matters pertaining to government support (Article 11 of the draft).
G. It stipulates the details, methods, and cost support procedures for the project to promote digital transformation in the electricity industry (Articles 12 to 14 of the draft).
H. It stipulates other types of financial and administrative support, as well as support for the electricity industry technology standards project (Articles 15 to 16 of the draft).
I. It stipulates the procedures necessary for forming an inter-agency consultative body in the electricity industry, the main items for discussion of the body, and the scope of participation, etc. (Article 17 of the draft).
J. It stipulates the matters to be included in the articles of association, the main tasks of the association, the procedures for establishing a new association, and the matters to be managed and supervised by the association (Articles 18 to 20 of the draft).
K. It stipulates the matters concerning the supplementary provisions of special laws, such as the delegation and entrustment of authority (Article 21 of the draft).
