1. Reason for the Revision
The Framework Act on Intelligent Informatization has been revised (Law No. 20410; promulgated on March 26, 2024) to require persons or entities that install and operate unmanned information terminals to take measures to promote information access and user convenience for the disabled and the elderly, including the appointment of personnel who can assist them with the use of unmanned information terminals; and to provide the grounds for corrective orders and the imposition of penalties. The proposed revision provides the matters delegated by the Act and the matters required for its enforcement, including the detailed contents of measures for enhancing disabled and elderly persons’ access to and use of information, the procedures and methods for imposing corrective orders, and the details of the penalties that may be imposed.
2. Main Contents
a. Specification of measures for improving accessibility and convenience of unmanned information terminals (Article 34-5, attached Table 3-2 of the draft)
1) The revision stipulates the scope of the installers and operators of unmanned information terminals who are subject to the amendments to the Act and are legally required to guarantee convenience of use for disabled and elderly persons.
2) The revision provides specific measures for facilitating access to information and the use of unmanned information terminals, such as the deployment of assistive personnel and real-time voice guidance services.
b. The revision provides the period, procedure, and method by which the Minister of Science and ICT may issue a corrective order to persons or entities that fail to take measures to facilitate access to information and the use of unmanned information terminals (Article 34-6 of the draft).
c. The revision provides detailed standards for the imposition of penalties in the event of failure to fulfill corrective orders, and the requirements for abating such penalties (Article 56, attached Table 5 of the draft).
d. The revision provides the contents, methods, procedures, etc. for conducting field surveys of unmanned information terminals that have been upgraded by the Act (Article 34-7 of the draft).
