  1. Reason for Amendment
    The amendment aims to reduce the burden of document submission for construction businesses by excluding the capital requirement from the registration and evaluation criteria when adding a new main field of expertise for specialized construction businesses. It also seeks to ease the qualifications for small-scale construction projects by adding the installation and modification of certain gas facilities, including ranges and their ancillary facilities, to the scope of second-class gas facility construction. In addition, the amendment modernizes the content and examples of the work tasks for each construction sector, and recognizes temporary cases where a construction business is unable to provide a certificate of guaranteed amount following a transfer, treating such cases as exceptions to the non-compliance with registration standards, thereby excluding them from administrative penalties such as registration cancellation.

  2. Key Provisions

    a. When adding a new main field of expertise for specialized construction businesses, it is stipulated that the business must meet the technical capability, facility, and equipment criteria, excluding the capital requirement (Article 7-2).
    b. Clarification of the exceptions to the field placement criteria for construction technicians (Article 35, Paragraph 2 and Appendix 5).
    c. An addition to the exceptions for temporary non-compliance with registration standards after the transfer of a construction business, where the business has not been able to provide a certificate of guaranteed amount within 50 days after the registration acceptance (Article 79-2).
    d. Clarification of the Minister of Land, Infrastructure, and Transport's authority to impose sanctions in the event of a major construction site accident as defined by the Construction Technology Promotion Act (Article 86).
    e. The addition of "the installation or modification of ranges and their ancillary facilities with a capacity of 14,400 kcal/h or less" to the scope of second-class gas facility construction under the gas and heating construction sector (Appendix 1).
    f. Revision of the work content and examples for each construction sector to reflect advancements in construction techniques and changes in construction sites (Appendix 1).
    g. A regulation for the period of business suspension imposed when a national or local government requires a business suspension under other laws (Appendix 6).
