1. Reason for Amendment
To implement a deposit-refund system for fishing gear and buoys, this amendment designates certain types of gear—such as traps used in coastal and offshore eel trap fishing, nets used in coastal and offshore gillnet fishing, buoys used in fisheries and coastal operations, and traps used by non-fisheries persons for harvesting marine resources—as subject to deposit charges. It also establishes a legal basis for providing rewards to individuals who report non-compliance by relevant businesses.


2. Key Provisions
a. Definition of fishing gear and buoys subject to the deposit-refund system (Proposed Article 49-2)

- In accordance with Article 81(1) of the Fisheries Act, traps used in coastal/offshore eel trap fishing, nets used in coastal/offshore gillnet fishing, and traps designated under Article 7-2(1)(1)(d) of the Enforcement Decree of the Act on the Management and Conservation of Marine Resources will be subject to deposit requirements.
- Buoys used in coastal/offshore fishing as defined in Article 81(1) of the Fisheries Act, and buoys used in fishing grounds under Article 13(13) of the Fishing Ground Management Act, will also be subject to the deposit-refund system.

b. Reward method and procedure (Proposed Article 73(3))

- A legal basis will be established to set the standards, methods, and procedures for granting rewards to individuals who report non-compliant businesses (i.e., producers or importers of fishing gear) that fail to adhere to the deposit-refund system.
