1. Background of the Initiative
∘ In response to the growing social issues caused by illegal spam, such as personal information leaks and financial fraud—which have become serious threats to public welfare—the Telecommunications Business Act (amended bill promulgated on March 18, 2025, and scheduled to take effect on September 19, 2025) newly stipulates in Article 22 (Reporting of Value-Added Telecommunications Services), Paragraph 2, that providers of certain types of value-added telecommunications services (hereinafter referred to as “bulk SMS transmission service providers”) must obtain a transmission qualification certification from the Korea Communications Commission (KCC), and register the certificate with the Ministry of Science and ICT (MSIT) as a precondition for providing services.
*Article 22, Paragraph 4 of the Act delegates authority to a Presidential Decree to require periodic inspections—at least once per year—by the relevant ministries to verify compliance with the registration requirements outlined in Paragraph 2.
∘ The proposed amendment to the Enforcement Decree of the Telecommunications Business Act (Article 29-2: Inspection of Compliance with Registration Requirements) aims to enhance regulatory predictability for regulated entities by specifying the content of regular inspections and the methods by which they are conducted.
2. Regulatory Details
∘ Regular inspections for certified bulk SMS service providers will examine:
*Whether the provider continues to meet the certification criteria
*Whether any grounds exist for cancellation of the certification
∘ The inspections may be conducted via document reviews, on-site inspections, or through electronic means.
