By specifying the criteria, procedures, and methods for disclosing frequently complained online shopping malls, the aim is to guarantee the procedural rights of business operators during the disclosure process and enhance consistency in law enforcement and procedural transparency.
2. Key Contents
a. Selection of Frequently Complained Online Shopping Malls (Article 4 of the Draft)
- Online shopping malls that receive more than 10 consumer complaint cases related to e-commerce in a month from the Korea Consumer Agency and Seoul Metropolitan City will be selected as frequently complained online shopping malls.
b. Opportunity for Explanation (Article 5 of the Draft)
- Business operators will be informed that they may be publicly listed as frequently complained shopping malls and will be required to submit explanatory materials within 5 business days regarding the complaints.
c. Decision on Public Disclosure of Frequently Complained Online Shopping Malls (Article 6 of the Draft)
- If the shopping mall’s location is unknown, contact is lost, no explanation materials are submitted without justifiable reasons, or the explanation is inadequate, the shopping mall will be decided to be publicly disclosed.
d. Method of Disclosure (Article 7 of the Draft)
- The name of the shopping mall, domain, and details of the complaints will be disclosed on the Fair Trade Commission website and the Consumer24 website.
e. Disclosure Period (Article 8 of the Draft)
- The disclosure will last for 6 months from the start date of the disclosure. However, if all consumer complaints are resolved, the disclosure may be terminated immediately.
