1. Purpose of the Amendment
With the amendment of the Special Act on the Safety and Maintenance of Facilities (Law No. 20553, promulgated on December 3, 2024, and to be implemented on December 4, 2025), this draft aims to establish necessary provisions for matters delegated by the law, such as the subjects for detailed safety inspections, emergency safety measures, and maintenance/strengthening obligations. It also seeks to define specific deadlines for facility repairs/strengthening and requirements for the composition and operation of the Facility Accident Investigation Committee, thereby promoting effective safety management and activating the operation of the committee.
2. Key Points
a. Definition of Targets for Detailed Safety Inspections (New Articles 10, Paragraphs 2 and 3)
- Facilities designated with safety grades D or E, including Type 2 facilities, and Type 3 facilities designated with safety grades C, D, or E, which have not undergone detailed safety inspections within 30 years after completion, will now be required to undergo such inspections.
b. Definition of Obligations for Emergency Safety Measures, Maintenance, and Strengthening (New Article 18-2)
- Facilities designated with safety grades D or E will be required to implement emergency safety measures and maintenance/strengthening to enhance the safety management of vulnerable facilities.
c. Shortening the Deadline for Facility Maintenance and Strengthening Obligations (Amendment to Article 19)
- The amendment stipulates that measures must begin within one year of the obligation arising, and the work must be completed within one year from the start date, unless there are special circumstances. This aims to ensure prompt repairs and strengthening of vulnerable facilities for public safety.
d. Change in the Composition Requirements for the Central Facility Accident Investigation Committee (Amendment to Article 37)
- The current regulation allows the formation of the Central Facility Accident Investigation Committee only when there are three or more fatalities or missing persons. The amended regulation reduces this to one or more fatalities or missing persons, expanding the scope of incidents subject to investigation by the committee.
