[Background]


1. In the case of trainees seeking qualification as mental health professionals, they hold a dual status as both a trainee and a worker. Therefore, when they work outside of their training duties, the Labor Standards Act should apply, but many training institutions fail to comply with this.


2. Under current law, there is no legal basis to evaluate training institutions or to issue correction orders or revoke designation based on the evaluation results. Consequently, systematic and thorough management of training institutions is not being achieved


3. Accordingly, there is a need to establish a legal basis to conduct evaluations of training institutions and to issue correction orders or revoke designation based on the evaluation results, thereby allowing for systematic and thorough management of these institutions.


[Main Points]


1. Mental health professional training institutions must meet appropriate standards regarding the training environment, training operation, and training resources, and must undergo a training institution evaluation every three years.


2. The Ministry of Health and Welfare (MOHW) may revoke the designation of a mental health professional training institution if it was designated through false or fraudulent means, or if it fails to meet the evaluation standards.
