[Background]
The current regulation stipulates that when an airline establishes an additional route (Article 90, Paragraph 5, Subparagraph 3 of the Act), it must apply for a Safety Management System Change Inspection no later than five days before the scheduled commencement date of operation.
However, in the actual process of an airline preparing for operation, the five-day period is excessively tight. This raises concerns that our Ministry (Aviation Operations Division) may not be able to fully conduct the change inspection, or if the inspection is not passed, the commencement of operation becomes impossible, potentially causing harm to passengers who have already booked tickets. Furthermore, due to such passenger harm and scheduling pressures, concerns are also being raised about a failure to secure safety, such as an inability to fully verify and supplement the data related to the change in the safety management system.
Accordingly, by extending the application deadline from five days to 30 days before the scheduled commencement date of operation, the aim is to allow airlines sufficient time to prepare for and undergo the change inspection, thereby enhancing aviation operational safety and protecting the rights and interests of air travelers.
