1. Background of Promotion

- Context: Following the enforcement of the Framework Act on the Advancement of Artificial Intelligence and Establishment of Trust (enforced Jan. 22, 2026), this amendment establishes a detailed framework to manage the approval system for AI institutes by defining founding entities, eligibility criteria, permit procedures, and operational details pursuant to Article 22-2.
- Necessity of Government Intervention: AI is a strategic technology with widespread impacts on national security, data privacy, industrial competitiveness, ethics, and social safety. The government must verify research goals, security frameworks, expert talent, and facilities right from the founding stage to ensure public interest and safety. This approval system builds a responsible, capability-driven research ecosystem while preventing redundant investments and an unchecked surge of reckless institutions.


2. Regulatory Content

- Defining Founding Entities & Requirements (Draft Article 16-2): Clarify the eligible entities and define strict approval criteria, including human and material resource standards, financial capability for self-sustained operations, physical/technical security measures, and a 3-year business plan.
- Specifying the Approval Process (Draft Article 16-3): Outline the exact required documents, procedures, and forms for applying for AI institute permits or reporting modifications, ensuring administrative clarity and structural consistency.
