Following the wholesale amendment of the Special Act on Remedy and Support for Humidifier Disinfector Health Damage (Act No. 21526, promulgated on April 7, 2026, taking effect on October 8, 2026)—which transitions the system from damage relief to a compensation framework—this draft aims to specify matters delegated to the Enforcement Decree, such as the types and composition of expert committees under the Compensation Committee and the criteria for determining compensation amounts, while prescribing necessary details for implementation, including the application and payment procedures for compensation.
2. Main Contents
A. Operation of the Compensation Deliberation Committee, and Term of Office and Dismissal of Committee Members (Draft Articles 4, 6, and 7)
Specifies the term of office for committee members as 2 years (renewable up to 2 times only) and prescribes grounds for dismissal, such as inability to perform duties due to mental disorders or involvement in duty-related misconduct.
B. Composition and Operation of Expert Committees for Professional Review of Deliberation Agenda (Draft Articles 4, 6, and 7)
Establishes the Investigation and Determination Expert Committee and the Re-deliberation Expert Committee as expert committees, and stipulates the number of members (up to 50 for Investigation/Determination, up to 30 for Re-deliberation) along with detailed member composition (medical specialists, judges, prosecutors, etc.).
C. Required Documents for Compensation Application (Draft Article 15)
Requires new applicants to submit identity verification, proof of existing damage (medical expenses, nursing care expenses, funeral expenses, death, etc.), proof of future damage (estimates of future medical expenses, disability certificates), income verification, etc.
D. Criteria for Determining Compensation Amounts, etc. (Draft Article 17)
Stipulates that in the event of death due to humidifier disinfector health damage, survivor compensation, funeral expenses, and consolation money are to be determined; in the event of health damage, medical expenses, nursing care expenses, compensation for suspension of work, disability compensation, and consolation money are to be determined.
E. Agreement to Compensation Determination and Application for Compensation Payment (Draft Articles 20 and 21)
Requires victims seeking to receive compensation to submit a compensation agreement and payment application form to the Deliberation Committee.
F. Educational Support for Victims (Draft Articles 29 and 30)
Allows assignment to a nearby school upon entering middle or high school, and enables tuition support for up to 8 semesters for those attending universities or colleges.
G. Calculation of Relief Contributions for Humidifier Disinfectors (Draft Article 36)
Calculates the contribution of humidifier disinfector businesses by deducting the contribution of raw material businesses from the total contribution payable by businesses, according to a formula considering the humidifier disinfector usage ratio and sales volume ratio, etc.
H. Relief Contributions of Humidifier Disinfector Raw Material Businesses (Draft Article 38)
Requires humidifier disinfector raw material businesses to pay a separate contribution equal to 45/100 of the contribution paid by humidifier disinfector businesses.
I. Grounds for Public Announcement in Case of Non-payment by Obligors (Draft Article 43)
Requires that when publicly announcing non-payers of contributions, details including their names and trade names must be published in the Official Gazette and on the website of the Ministry of Climate, Energy and Environment.
