1. Reason for Amendment
- To prevent illegal subcontracting and foster a fair bidding and competition environment, this amendment aims to clearly stipulate the method for stating details in bidding public notices when commissioning construction works.


2.Main Contents

A. Stating the Applied Amount and Ratio of New Technologies and Patented Construction Methods in Bidding Public Notices (Newly inserted Paragraph 5 of Article 8)

- When ordering construction works applying new technologies or patented methods under each item of Article 31-2 of the Enforcement Decree of the Framework Act on the Construction Industry, project owners must explicitly state the applied amount and its ratio relative to the estimated construction cost in the bidding public notice. This preemptively blocks illegal subcontracting risks arising from a lack of information to determine the feasibility of subcontracting prior to bidding, and helps construction businesses accurately analyze profit and loss and check compliance with regulations before participating in bidding.


B. Improving the Method of Stating in Bidding Public Notices When Commissioning Complex Maintenance Works as Specialized Construction (Amendment to Article 9)

- When a project owner commissions complex maintenance works consisting of two or more specialized construction categories as specialized construction, joint contracting among specialized construction businesses is permitted. This guarantees bidding participation opportunities for small and medium-sized specialized construction companies that fell into a blind spot following the abolition of the facility maintenance business, thereby eliminating barriers to entry.
