1. Background for Promotion

ㅇ (Background) Following the amendment of the Occupational Safety and Health Act (October 22, 2024), specific health protection obligations for employers to prevent health disorders caused by working in cold waves or for extended periods in cold weather are stipulated by Ordinance of the Ministry of Employment and Labor. 

ㅇ (Necessity of Government Intervention) It is necessary to clearly prescribe and ensure compliance with employers' obligations to protect workers exposed to cold waves.

2. Regulatory Contents 

ㅇ Appropriately allocate work and rest periods and adjust working hours. However, if it is difficult to adjust working hours, appropriate measures must be taken to reduce body temperature drops, such as having workers wear thermal clothing, etc.

- Violations of this Rule constitute a violation of Article 39, Paragraph 1 of the Act, subjecting the violator to Subparagraph 1 of Article 168 of the same Act (imprisonment for not more than 5 years or a fine not exceeding 50 million won).
