[Background]

In accordance with the "Plan to Improve the Management Fee System for Multi-Family Housing" (May 2026), this amendment aims to reduce management fees by promoting competitive bidding. This is achieved by rationalizing the targets for negotiated contracts (private contracts) and strengthening the requirements and establishing standards for limited competitive bidding. Additionally, it seeks to enhance public convenience by simplifying and clarifying bidding methods and procedures.

[Main Points]

A. Relaxing the requirement for establishing limited competitive bidding from three to two or more valid bids (Draft Article 8).

B. Strengthening requirements for limited competitive bidding based on technical capabilities by mandating the completion of usage agreements, etc., with the consent of all residents, etc., and stipulating that capital requirements be set within twice the statutory standard (Draft Attached Table 2).

C. Minimizing exceptions to the application of competitive bidding, such as for insurance and manufactured goods contracts, and for the renewal of contracts with existing business operators for services other than security and cleaning (Draft Attached Table 3).

D. Reorganizing redundant provisions regarding the invalidation of bids (Draft Attached Table 4).

E. Explicitly designating the selection of business operators for the entrusted installation and operation of fixed electric vehicle chargers as a subject to which the guidelines apply (Draft Article 29).

F. Allowing residents to determine important bidding matters for construction projects utilizing the long-term repair and maintenance fund when the council of occupants' representatives is unable to make a resolution (Draft Article 5).

G. Improving the process so that invalid bids are disclosed collectively at the time the successful bidder is announced (Draft Article 9).

H. Requiring the inclusion of matters concerning the composition of the multi-family housing management organization in the bid announcement for the selection of a housing management entity (Draft Article 17).

I. Rationalizing the restriction on participation qualifications for those who have provided money, valuables, etc., in connection with a bid (Draft Articles 19 and 26).

J. Clarifying the requirement to execute a contract when proceeding with a negotiated contract (Draft Articles 21 and 28).

K. Extending the verification period for administrative dispositions under the eligibility screening system for the selection of housing management entities from one year to two years (Draft Attached Table 5).
