[Background]
As the Act on the Acquisition of Land, etc. for Public Works and the Compensation Therefor has been amended (Act No. 21810, promulgated on June 16, 2026) to enable the imposition of enforcement fines on those who fail to fulfill their obligations to deliver or relocate land or goods, this amendment aims to prescribe the criteria for imposing enforcement fines and the fulfillment periods delegated by the Act. Furthermore, it seeks to establish a legal basis allowing compensation-related notifications to be sent via information and communications networks in addition to standard postal mail.
[Main Points]
A. Permitting notifications under the Land Compensation Act to be made using information and communications networks if the recipient consents, and stipulating that Article 14, Paragraphs 3, 5, and 6, and Article 15, Paragraph 2 of the Administrative Procedures Act shall apply mutatis mutandis regarding the methods and effective timing of such notifications (Draft Article 3-2).
B. Prescribing the fulfillment period necessary for the delivery or relocation of land or goods prior to the imposition of an enforcement fine as a reasonable period within the range of 3 months, and prescribing the specific criteria for imposing enforcement fines in an attached table (Draft Article 47-2).
C. Setting the amount of the enforcement fine at 10 million won, provided that for the initial imposition, the fine may be reduced by up to 50 percent in consideration of the motive for the violation, the degree and consequences of the non-fulfillment of obligations, and the efforts made to fulfill the obligations (Draft Attached Table 3).
