Reasons for Proposal

The current Act prescribes that a person who engages in the sales, rental, sales brokerage, buying agency, or import agency through Internet of products subject to safety certification, safety assurance or the supplier's assurance of conformity shall publish information about safety certification in the relevant website so that consumers can find such information; and shall not act as a sales broker, buying agent, or import agent for the products without the safety certification mark, etc. Yet, the Act prescribes different obligations for mail order brokers.

Critics say that it is necessary to impose the same obligations on mail order brokers to protect the consumers engaging in transactions since mail order brokers themselves charge a fee on the retailers concerned and provide transaction opportunities although they are not directly involved in individual transactions.

Accordingly, the Amendment prohibits mail order brokers from engaging in sales brokerage for the products without the safety certification mark by deleting the clause on the exclusion of mail order brokers from the current Act (Article 9, Article 10, Article 18, Article 19, Article 25 and 26).
