Reasons for Proposal

The current Act obligates rental business entities of privately constructed rental housing and commercial rental business entities that are supplied with all houses for sale to purchase a guarantee for rental deposit.

Recently, however, there have been cases where lessees were unable to be refunded with the rental deposit due to unpaid taxes, etc., of rental business entities of buy-to-rent private housing who have not been obligated to purchase a guarantee for rental deposits. In this regard, critics have suggested expanding the scope of rental business entities required to purchase a guarantee for rental deposit to protect the property of lessees from the bankruptcy, etc., of rental business entities.

Accordingly, the Amendment expands the scope of entities required to purchase a guarantee for rental deposits to cover any commercial rental business entity that has acquired or intends to acquire not less than 100 units of buy-to-rent private housing, thereby aiming to strengthen the protecitve measures for rental deposit (Article 49, paragraph 1 and Article 49, paragraph 2).
