Reasons for Proposal

The current Act requires the employer to take health action to prevent any injury due to droplets or pathogens floating in the air, and in this regard, sets forth, advises and recommends the Office Air Management Guidelines.

However, as cluster infections have broken out around businesses where workers are located in densely populated sections of the worksite during the spread of the recent COVID-19 pandemic, it has been suggested to limit the number of workers per area in a workspace to prevent cluster infections when there is a concern about the spread of any infectious disease.

In the event that a state of disaster under the Framework Act on the Management of Disasters and Safety is declared due to the outbreak of any infectious disease, this Act aims to require the employer to keep the number of workers per area in a workspace under the level prescribed by Presidential Decree by considering the type of business and the number of fully present workers in a business (Article 39-2 newly inserted and Article 175, paragraph 6, subparagraph 3).


Major Provisions

Require the employer to keep the number of workers per area in a workspace under a certain level and impose administrative fines for any violation of the foregoing in the event that a state of disaster under the Framework Act on the Management of Disasters and Safety is declared due to the outbreak of any infectious disease (Articles 39-2 and 175).
