Reasons for Proposal

Currently, only buildings designated by the permitting authority are verified by the said authority as to whether supervision costs have been paid, but the Amendment aims to extend the scope of buildings subject to verification of payment of supervision costs by the permitting authority to include all buildings subject to supervision so as to secure supervisory independence and effective supervision. 

As mass casualty events caused by fires such as the fire accident in a warehouse in Icheon continue to occur in recent years, the Amendment aims to strictly manage the quality of major building materials for fire safety and devise fire safety standards for windows that currently have no standards, thereby enhancing the fire safety standards for buildings.

Although the current working committee for construction-related dispute resolution is an alternative dispute resolution body that minimizes the burden on people by quickly addressing issues without going through any judicial procedure in court, it lacks effectiveness in the results of mediation and arbitration, giving rise to difficulty in achieving the establishment purpose of the committee.  Therefore, the Amendment aims to grant the results of mediation and arbitration of the committee for construction-related dispute resolution the same effect as compromise in court, thereby enhancing the effectiveness of the results of mediation and arbitration of the committee. 

Details

A. Extend the scope of buildings subject to verification of the payment of supervision costs by the permitting authority from those designated for supervision by the said authority to include all builds subject to supervision (Article 25 (11)

B. Formulation of fire safety standards for windows (Article 52 (4) and (5))

1) Require the use of materials that do not disrupt fire prevention.

2) To prevent the spread of fire to an adjacent building through windows, where the distance between the exterior walls of the building and the border with the adjacent land is short, require the windows to have the performance that prevents the spread of fire. 

C. Introduction of quality approval system (Article 52-5 newly inserted)

1) Require the verification of quality control status from the production process in the factory, not just the performance of materials, to ensure the quality control capacity to produce materials, and have the quality approval authority conduct random inspections of manufacturing, distribution, and construction sites each year, thus introducing the quality approval system to ensure that construction materials with a certain performance are used at sites. 

2) Require the verification of the quality control status and material performance test results at factories with the introduction of the quality approval system for building materials, and ensure that stricter quality control is carried out through random inspections of factories and construction sites, and the cancellation of approval and revised penalties for companies in violation.

D. Grant the same effect as compromise in court so as to grant legal force if the results of mediation and arbitration of the working committee for construction-related dispute resolution fail to be implemented (Article 96 (4) and Article 99)
