Reasons for Proposal

As part of the mobility revolution associated with the Fourth Industrial Revolution, the supply and use of personal mobility devices such as electric autopeds are rapidly spreading. 

In particular, as the spread of COVID-19 has highlighted the advantages of non-face-to-face means of transportation, the demand and supply of electric autopeds has rapidly expanded, and it is now easy to find personal mobility devices using or occupying roads.

Despite the fact that traffic accidents caused by personal mobility devices have rapidly increased to almost double every year due to the increased number of users, the lack of related institutions has raised public concerns over their frequent violations of traffic laws and causing dangerous situations. 

In addition, personal mobility devices are frequently left unattended on the road, causing harm to the mobility convenience and safety of other transportation users, and the infrastructure for docks and parking and the regulations on building them are not well organized.

On the other hand, despite the rapid growth of the sharing service for electric autopeds, there is no distinction for the industry related to the electric autoped sharing service, and there are no minimum safety measures necessary for the safety of the public, such as the obligation to hedge against the risk of safety-related accidents that may occur while owning, possessing or using electric autopeds.

Therefore, the Act aims to establish the status of electric autopeds, etc. with secured or certified safety among personal mobility devices as one of the new means of transportation, build safety nets necessary for their safe use, and at the same time promote the convenience of personal mobility devices. 

Details

A. Impose the duty on national and local governments to establish master plans for infrastructure construction and management, traffic safety training, and safety and convenience in relation to personal mobility devices (Article 3).

B. Allow the Mayor/Governor or the Mayor/head of a Gun/Gu to designate and publicly announce the roads and routes for personal mobility devices, and prepare facility standards (Article 5).

C. Allow the Mayor/Governor or the Mayor/head of a Gun/Gu to designate, operate, prohibit, or restrict the docking areas for personal mobility equipment (Article 8).

D. Establish the principles for traveling on personal mobility devices (Article 11).

E. Establish the duty to prohibit people from leaving personal mobility devices unattended, and devise the grounds for the Mayor/Governor or the Mayor/head of a Gun/Gu to dispose of personal mobility devices left unattended (Article 12). 

F. Prohibit the illegal modification of personal mobility devices and the operation of illegally modified personal mobility devices on the road (Article 13).

G. Impose the duty to provide education on the safety of personal mobility devices on primary and secondary schools, local governments, personal mobility equipment vendors, and rental businesses (Article 14).

H. Impose the duty to have insurance on personal mobility device rental businesses, manufacturers, and vendors (Article 16).

I. Impose the duty on personal mobility device rental businesses to register and declare the rental terms and conditions to the relevant Mayor or Governor (Articles 17 and 19).

J. Set out the requirements for personal mobility devices available for rental businesses and impose the duty to attach license plates to personal mobility devices for rental businesses (Article 18). 

K. Impose the duty to establish a driving qualification verification system to verify the qualifications of those who wish to lease personal mobility devices (Article 21).
