Reasons for Proposal

Recently, due to the rise in e-commerce caused by the prolonged infectious disease, the shipping volume has increased by more than 20% year-on-year, and as a result, delivery workers have been exposed to long hours of work resulting in many deaths. 

However, some have pointed out that, since delivery workers are not defined as workers under the “Labor Standards Act,” they are not subject to the restriction on working hours, and thus there is no legal mechanism to protect them from overwork, and even workers in industries that have received special exceptions for working hours and rest hours under the “Labor Standards Act” may be more easily exposed to the risk of overwork compared to ordinary workers. 

Therefore, the Amendment aims to oblige employers or contractors to take health measures such as reducing working hours and guaranteeing rest hours to prevent damage to the health caused by long working hours for workers in industries that have received special exceptions for working hours and rest hours under the “Labor Standards Act” and parcel transportation workers, and to include them in those who are subject to special health checkups, so as to prevent occupational accidents caused by overwork and create a more pleasant work environment, thereby further protecting the safety and health of workers and special type workers.
