Reason for the Proposal and Main Contents

With the spread of the digital economy and the development of artificial intelligence (AI) technologies, data are now considered to be an essential production factor given that diverse customized user services are being provided based on data, contributing to the improvement of user rights and interests.

However, if data are concentrated exclusively around certain business operators due to the intensification of data competition, this may act as a strong barrier to market entry for new operators; and it is also feared that it may have an adverse effect on innovation, competition, and user rights and interests in the long term.

Therefore, the bill aims to build a sustainable digital ecosystem by obligating telecommunications operators that meet certain criteria, such as the number of users and sales, to provide data to resolve the data access gap (new Article 2(11) and Article 42(2)).
