1. Reasons for Proprosal
As the Road Traffic Act was amended (Act no. 15364; promulgated on February 9, 2018) to secure the safe passage of fire-fighting vehicles, this Amendment aims to prescribe that any area within 5 meters of the fire-fighting systems specified by the Act on Fire Prevention and Installation, Maintenance, and Safety Control of Fire-Fighting Systems (hereinafter “Fire-Fighting Systems Act”) and designated by Presidential Decree shall be a no-parking/no-stopping zone, thereby modifying the subordinate statute accordingly.
2. Major Provision
Specify that the area within a 5-meter radius of any fire-fighting system that is a fire department connection, fire-fighting water equipment, or wireless access point under the Fire-Fighting Systems Act shall be a no-parking and no-stopping zone.
3. Amendment Details
Partial Amendment to the Enforcement Decree of the Road Traffic Act
Amend the Enforcement Decree of the Road Traffic Act as follows.
Newly insert Article 10-3 as follows.
Article 10-3 (Places where Stopping or Parking is Prohibited) In Article 32, subparagraph 6, item (b) of the Act, “fire-fighting facilities prescribed by Presidential Decree” means the following equipment in the attached Table 1 of the Enforcement Decree of the Act on Fire Prevention and Installation, Maintenance, and Safety Control of Fire-Fighting Systems.
1. Any fire-fighting equipment that is a fire department connection for an indoor hydrant system, sprinkler system, etc., or water spray fire extinguishing equipment, etc.;
2. Any fire-fighting water equipment;
3. Any equipment for fire-fighting activities that is a fire department connection for a standpipe system, externally-connected spray system, or flame retardant system, or that is a wireless access point for auxiliary wireless communication equipment.
Addenda
Article 1 (Enforcement Date) This Decree shall enter into force as of the day of promulgation.
