(1) Reasons for Proposal

This Amendment harmonizes the relevant provisions in accordance with the partial amendment to the provisions of the Standards for labelling for Food, etc. (Ministry of Food and Drug Safety Notice no. 2018-32; April 26, 2018) concerning the labeling of children's favorite foods and other allergenic foods; and also specifies the online scope prescribed in the allergen labeling instructions.

(2) Major Provisions

A. Expand the scope of allergens subject to labeling (Article 3, paragraph 2)

1) Realign the relevant provisions with the amended Standards for labelling for Food, etc.

2) Prescribe that the scope of allergens subject to labeling under the Standards of labeling for Food, etc. shall apply mutatis mutandis to children's favorite foods and other allergenic foods

3) Reduce confusion in civil services by aligning the regulations

B. Specify online scope to amend the terms thereof (Article 4, paragraph 2, subparagraph 2)

1) Clarify the scope of the term to clarify the applicability of provisions.

2) Clearly specify that the online scope shall be “websites, mobile applications, etc.”

3) Enhance understanding in civil services by clarifying provisions

(3) Amendment Details

Partial Amendment to the Food Allergen Labeling Standards and Methods for Children's Favorite Foods, etc.

Partially amend the Food Allergen Labeling Standards and Methods for Children's Favorite Foods, etc. as follows.

Article 3 (2) shall be as follows.

② Where a food subject to allergen labeling specified in Section II. 2. A. 1) A) of the Standards for labelling for Food etc., is used or contained, the business operator shall indicate the names of the ingredients concerned.

In Article 4 (2) 2, change “website or other online media” to “website, mobile application, or other online media,” and change “corresponding website” to “corresponding website or mobile application.”

Addenda

Article 1 (Enforcement Date) This Notice shall enter into force on January 1, 2020.

Article 2 (Applicability) This Notice shall apply to foods prepared or sold on or after the enforcement date of this Notice; provided that this Notice may be applied to foods prepared or sold before the enforcement of this Notice if thus requested.
