(1) Reasons for Proposal

In accordance with the amendment to the Environmental Impact Assessment Act (promulgated by Act No. 15106, Nov. 28, 2017), this proposal aims to determine matters legally delegated and things necessary for the enforcement thereof such as the re-collection of opinions from residents, re-assessment of wrongfully prepared environmental impact assessment reports, approval for re-entrusting affairs and disclosure of violation, etc., and to modify the wordings of laws, etc., thereby resolving some inadequacies arising in the process of operating the current system.

(2) Major Provisions

A. Prepare grounds for re-collecting opinions from residents and procedures therefor (Article 7-2, Article 12-2 and Form 3-2 of Attachment)

Prescribe grounds for re-collecting opinions from residents and procedures therefor where there are procedural flaws in collecting opinions and 30 or more residents apply for re-collecting opinions from residents

B. Re-assess wrongfully prepared environmental impact assessment reports, etc. (Article 22-2)

Where a wrongfully prepared environmental impact assessment report is required to be re-assessed, determine matters concerning the conclusion of an entrustment contract for the selection of an agent entrusted to assess environmental impact, etc.

C. Approve re-entrustment of environmental impact assessments (Article 26-2)

Prescribe documents necessary for the re-entrustment of environmental impact assessments and procedures therefor after approval from the head of the agency that has ordered the preparation of the assessment report

D. Disclosure of violations (Article 37-2)

Determine media to disclose violations, such as the Internet, newspaper and broadcasting station, and content to be disclosed, such as the name of workplace and details of the violation and  dispositions
