(1) Reasons for Proposal

Article 22, paragraph 2 of the Enforcement Decree of the Pesticide Control Act which prescribes that the Administrator of the Rural Development Administration shall entrust part of affairs related to the education of sales managers under Article 23, paragraph 3 to a private organization was deleted (partially amended by Presidential Decree No. 28272, Sep. 5, 2017, and to be enforced Sep. 6, 2018). Accordingly, these guidelines aim to abolish the Rule on Designation of Organization Entrusted to Educate Pesticide Sales Mangers and Processing Affairs Entrusted notified by the Rural Development Administration, and prepare detailed guidelines necessary for educating current pesticide sales managers and persons who newly intend to be pesticide sales managers for selling pesticides in small packaging.

(2) Major Provisions

A. Define sales managers subject to education (Article 2)

1) Define sales managers subject to education as persons registered as sales managers in a certificate of manufacturing, importing or selling business

* Define persons who newly intend to be sales managers for selling pesticides in small packaging as persons who engage in a wholesale or retail business dealing with flowering plants

B. Prescribe guidelines on treatment of affairs related to the education of sales managers (Articles 3 through 11)

1) Require the Administrator of the Rural Development Administration to formulate an education plan containing the estimated number of persons subject to education, place and date of the education, etc., every year, and post it on the pesticide business registration and education management system, and require a City Mayor, Do Governor and the head of Si/Gun to notify the persons subject to the education of the established education plan (Article 3)

2) Include in the relevant education curriculum pesticide laws and regulations, guidelines on restrictions on the handling and safe use of pesticides, and require sales managers subject to education to receive at least six (6) hours of education (Article 4)

3) Prescribe guidelines on pesticide business registration and application for education, payment of education fees, and issuance of education certificate through education management system (Articles 5 through 7)

4) Require the Administrator of the Rural Development Administration to notify a City Mayor and Do Governor of persons subject to education, and require the City Mayor and Do Governor to notify the head of Si/Gun thereof (Article 8)

5) Require a City Mayor, Do Governor, the head of Si/Gun, Nonghyup and relevant associations to provide support in connection with the convocation of persons subject to education, finding an education place, management of education tutors and persons subject to education, etc., in accordance with the implementation of the education, and require a City Mayor, Do Governor, the head of Si/Gun to immediately input pesticide business registration or its modification into the pesticide business registration and education management system (Article 9)

6) Allow the Administrator of the Rural Development Administration to outsource part of affairs related to the education of sales managers, if necessary (Article 10)
