(1) Reasons for Proposal
The Amendment deletes testing agency recognition from the requirements for inspection agency designation following the transfer of the testing of heavy metal content in the flooring materials of children’s amusement facilities to the Ministry of Environment, applies the same insurance compensation standards for physical scars to both males and females, and otherwise addresses weaknesses that have emerged from the operation of the safety control system for children’s amusement facilities.
(2) Major Provisions
A. Delete testing agency recognition from the requirements for inspection agency designation since the work of testing heavy metal content in the flooring materials of amusement facilities has been transferred (January 1, 2017) to the Ministry of Environment (Article 5)
B. Prescribe grounds on which to postpone inspections of water play equipment for up to 3 months in the event that extremely cold temperatures or other weather events make it impossible to conduct an inspection (Article 7, Article 8)
C. Clarify calculations standards for extensions of the routine facility inspection period and the valid period of a pass judgment (Article 8)
1) Modify the routine facility inspection period from “for one month prior to the expiration of the pass judgment from the immediately preceding inspection” to “for two months.”
2) Prescribe that where an inspection has been conducted during a routine facility inspection period, the starting point of the valid period of the pass judgment shall be “the day following the expiration date of the pass judgment from the immediately preceding inspection.”
3) Prescribe that where an inspection has been conducted outside a routine facility inspection period, the starting point shall be “the date of the pass judgment from the inspection concerned.”
D. Prescribe procedures and methods for reporting the demolition of children’s amusement facilities to the managing and supervising institution (Article 8-3)
E. Newly insert a grace period for purchasing indemnity insurance for children’s amusement facilities (Article 13), and prescribe the same insurance compensation standards for physical scars in both males and females (attached Table 7)
F. Modify other terms and forms
