(1) Reasons for Proposal
The Traffic Safety Act was amended (Act no. 15311; promulgated on December 26, 2017; to be enforced on December 27, 2018) to obligate the designation and education of persons in charge of traffic safety. Accordingly, this Amendment prescribes such matters as the scope of traffic facility installers/maintainers and transportation managers who shall designate persons in charge of traffic safety, and details concerning the duties, designation method, and education of persons in charge of traffic safety.
(2) Major Provisions
A. Prescribe duties of persons in charge of traffic safety (Article 44-2)
Prescribe the duties of persons in charge of traffic safety in accordance with provisions concerning the duties to be performed by traffic safety supervisor qualification holders, etc. who have been designated as persons in charge of traffic safety
B. Designate persons in charge of traffic safety (Article 44-3, attached Table 8-2)
Specify the scope of traffic facility installers/maintainers and transportation managers who are obligated to designate persons in charge of traffic safety and the designation method in accordance with the prescribed compulsory designation of persons in charge of traffic safety
D. Educate persons in charge of traffic safety (Article 44-4, attached Table 8-3)
Specify the administration method, etc., of the compulsory education for persons in charge of traffic safety
E. Add affairs concerning the designation and education of persons in charge of traffic safety to the scope of affairs that may be processed using unique identifiers (Article 47-2)
F. Entrust Korea Transportation Safety Authority with the education of persons in charge of traffic safety and designation of business entities with outstanding performance in traffic safety (Article 48)
G. Impose administrative fines for non-compliance with the designation and education of persons in charge of traffic safety (attached Table 9)
Impose an administrative fine of 5 million won for failure to designate persons in charge of traffic safety, and an administrative fine of 500,000 won for failure to ensure education of persons in charge of traffic safety
