(1) Reasons for Proposal
In accordance with the Safety Control Measures for Household Chemicals jointly announced by government departments in November 2016, the Amendment reclassifies cosmetic soaps, hair loss concealers, and depilatory waxes as cosmetics, among consumer products subject to safety standards compliance under Article 2, subparagraph 13 of the Electrical Appliances and Consumer Products Safety Control Act (Act no. 15338). The Amendment also clarifies grounds for administrative investigations in accordance with follow-up measures for the Administrative Investigation Reforms project.
(2) Major Provisions
A. Relax qualification requirements for cosmetics manufacture-sales managers (Article 8, paragraph 1 amended)
1) Cosmetic soaps, hair loss concealers, and depilatory waxes will be reclassified as cosmetics as a follow-up measure for the Safety Control Measures for Household Chemicals jointly announced by government departments in November 2016. This may cause an increasing need to consider difficulties that the affected businesses may face in meeting the qualification requirements for manufacture-sales managers.
2) Accordingly, the Amendment temporarily relaxes qualification requirements for manufacture-sales managers to account for difficulties that cosmetic soap, hair loss concealer, and depilatory wax businesses may face.
B. Advance provisions concerning the delegation of reports on cosmetics production/import performance and ingredient lists to ordinance level (Article 13, paragraph 1 amended)
The Amendment clarifies provisions in the Ministry of Food and Drug Safety's Notice of “Regulations on Reports on Cosmetics Production/Import Performance and Ingredient Lists” prescribing that reports may be filed with the Korea Cosmetic Association or Korea Pharmaceutical Traders Association by transferring the said provisions to an Ordinance of the Prime Minister in accordance with follow-up measures for the Administrative Investigation Reforms project.
