(1) Reasons for Proposal

There are no measures to control painting work, major repair work, small-scale construction work, etc., taking place near residential areas and thus provoking frequent complaints concerning fugitive dust. This has created a need for such works to be included and managed under the scope of works subject to reporting on fugitive dust generation. It is also necessary to strengthen the requirements for facility measures for fugitive dust suppression to improve the management of fugitive dust in response to recent events in which residents were adversely affected by coal ash scattering from the coal storage facility of a thermal power station, and increasing numbers of construction site-related complaints. The Amendment also addresses and improves upon a number of other weaknesses that have emerged from the operation of the current system.

(2) Major Provisions

A. Introduce grounds for which to manage small-scale construction work near hospitals, schools, etc. (proviso of Article 57)

Prescribe grounds to enact si/gun/gu ordinances requiring any work carried out within 50 meters from a hospital, school, etc., to file a report as a business establishment generating fugitive dust regardless of scale

B. Streamline regulations on the scope of targets required to file reports on alteration (Article 58, paragraph 2, subparagraph 3)

Require a report on alteration in which an initially reported business is increased in scale by 10% or more or further types are added, and prescribe a proviso that requires any construction site or business establishment subject to special control to file a report for any alteration less than 10% in scale as per current provisions

C. Include construction work provoking large numbers of complaints in the scope of businesses subject to reporting (attached Table 13)

Include in the scope of businesses subject to report any painting work carried out by apartment housing, major repair work with a gross floor area of not less than 1,000m2, and any farmland development or rearrangement work that has a total construction area of not less than 1,000m2 and involves the deposition/removal of soil using a transportation vehicle or a combination of earthworks, grading work, etc.

D. Strengthen the requirements for facility measures for fugitive dust suppression (attached Table 14)

Strengthen the requirements for facility measures to manage business establishments generating fugitive dust such as by prescribing the indoor installation of coal storage facilities of thermal power stations, compulsory use of rollers for painting work, and compulsory use of low-pollution construction machinery; and clarify dust screen porosity requirements (around 40%) and streamline a number of other standards for facility measures for fugitive dust suppression
