1. Reason for proposal

As the draft for revision of the Act on the Promotion of Development and Distribution of Environment-friendly Motor Vehicles was pronounced (July 27, 2021) and intended to generate demand for environment-friendly motor vehicles and to improve charging convenience, Enforcement Decree of the Act is revised to prescribe legally delegated matters such as the embodiment of purchase-target enterprises.

 

2. Main content

A. Definition of enterprises related with environment-friendly motor vehicles and content of support (Article 2-2 and Article 17-2)

1) Purchase-target enterprises and battery lease enterprises, etc. are added to legally prescribed eco-friendly vehicle after-market parts enterprises and charging facility providers.

2) The basis to provide funding support for business conversion to environment-friendly vehicles, purchase of environment-friendly vehicles, and construction of charging facilities are provided.

 

B. Purchase-target enterprises of environment-friendly motor vehicles are prescribed (Article 18-4).

1) Subjects of purchase are embodied among legally prescribed as follows enterprises subject to disclosure, automobile lease businessmen, general taxi transportation operators, passenger transportation operators, and cargo truck transportation operators.

 

C. Strengthened liability for installation of environment-friendly motor vehicles charging facilities and installation of exclusive parking zones

(Article 18-5(1) and 18-5(2) and Article 18-6(2))

1) The subjects of liability are changed from “not less than 500 households” to “not less than 100 households” in the case of apartment houses and, in the case of public facilities, from “not less than 100 sides” to “not less than 50 sides” for total number of parking vehicles.

2) The ration of obligatory installation of exclusive parking zones is decided as 5% in the case of newly constructing facilities which were permitted for construction after enforcement of the Act, as 5% in the case of facilities possessed by public sectors such as government, local governments, and public agencies, etc. among the constructed facilities which were permitted for construction before enforcement of the Act, and as 2% in the case of other facilities.

3) The ratio of obligatory charging facilities to be installed in exclusive parking zones is decided as 5% in the case of newly constructing facilities and as 2% in the case of constructed facilities.

 

D. Definition of “adjacent areas” of innovative cities and specifications of hydrogen charging stations (Article 18-6(5) and (6)

1) In the case of adjacent areas, within 5km from boundary of innovative cities

2) Hydrogen charging stations shall have 25kg/hour or higher charging speed.

 

E. Actualization of charging impediment action (Article 18-7(6) through (8))

1) Long-time parking may be controlled even in the case of parking in the charging zones of fast/slow chargers.

2) Charging facilities may not be used for the purpose other than charging electric vehicles or hybrid vehicles (limited to the vehicles which may be driven with electricity from external electricity suppliers).

 

F. The range of public sector that charging facilities of environment-friendly motor vehicles shall be disclosed is prescribed below (Article 18-8(1) through (4)).

1) Government-funded research institutes, etc. are added, as the subjects of obligatory disclosure, to legally prescribed government, local government, and local public enterprises.

 

G. Order of correction and enforcement action (Article 18-10 and Article 18-11)

1) The procedures for and standard of imposing enforcement action are prescribed against the non-installation of environment-friendly motor vehicles charging facilities and exclusive parking zones.

 

H. Due date for installing charging facilities and exclusive parking zones in constructed facilities (Article 2 of Supplementary Provisions)
