Reasons for Proposal and Major Provisions

The cement kiln installation project was added to the list of projects subject to environmental impact assessment (amended Table 3 of the Enforcement Decree of the Environmental Impact Assessment, March 31, 2023). Accordingly, this Amendment adds “any recycled facility that is a cement kiln with a daily production capacity of 100 tons or more” to the scope of projects subject to the addition and assessment of health impact items pursuant to Article 12 of the Enforcement Decree of the Environmental Health Act, thereby aiming to prevent damage by reviewing and assessing the impact that environmentally hazardous factors emitted by cement kilns may have on public health.

In accordance with a recommendation from the Anti-corruption and Civil Rights Commission (No. 2021-95, approved on February 22, 2021), the Amendment also prescribes matters concerning the count and cumulative count of violations to prevent breaches of rights and confusion in legal compliance regarding administrative dispositions issued by environmental health centers.
