1. Reasons for Amendment

Pseudo names for herbal prescriptions, which are prohibited from being used as foods and can be potentially mistaken as medicines, are currently defined as names similar to herbal prescriptions. This proposal is intended to prevent consumer damage caused by these pseudo names by covering more names that combine formulation names related to herbal prescriptions, such as tang, jeon, ju, and yakju, and thereby can be mistaken or confused with herbal prescriptions. 


Meanwhile, a regulation is being proposed to exclude from labeling and advertising the raw materials or ingredients, which the Minister of Food and Drug Safety notifies as necessary to be labeled and advertised to help consumers make informed decisions, in the Enforcement Decree of the Act on Labeling and Advertising of Foods, which defines the scope of false labeling and advertising (Ministry of Food and Drug Safety Notification No. 2023-****, ** **, 2023). In this context, this Partial Amendment is proposed to determine the scope of labeling and advertising to help consumers make informed decisions.



2. Major Provisions


A. Increase the scope of names similar to herbal prescriptions that may result in foods being perceived as medicines ([Table 1])


B. Allow the labeling and advertising of raw materials or ingredients not used (Article 2 subparagraph 5)
