1. Reasons for Amendment


The previous “Maritime Safety Act” was renamed the “Framework Act on Maritime Safety” to clarify its framework act status regarding maritime safety control, and wholly amended (Act No. 19572; promulgated on July 25, 2023) to newly insert maritime traffic control policies and provisions on the development of a specialized workforce for maritime safety control and the promotion of the maritime safety industry. Various regulations for maritime safety control and matters pursuant to international conventions have been separately enacted under the “Maritime Traffic Safety Act” (Act No. 19573; promulgated on July 25, 2023) and accordingly, this Amendment wholly amends the previous “Enforcement Decree of the Maritime Safety Act” to the “Enforcement Decree of the Framework Act on Maritime Safety” and addresses and improves upon a number of weaknesses that have emerged from the operation of the current system.



2. Major Provisions

A. Change the “Enforcement Decree of the Maritime Safety Act” to the “Enforcement Decree of the Framework Act on Maritime Safety.”


B. Newly insert important matters to be discussed with the heads of the relevant central administrative agencies when modifying the National Maritime Master Plan (Article 2).


C. Newly insert designation criteria and procedures for specialized workforce development agencies (Article 5).

Specify designation criteria for specialized workforce development agencies applicable to maritime safety control in general, and clearly prescribe the scope of support.


D. Amend the previous member country audit response plan to the international convention compliance plan (Article 8).


E. Newly insert matters concerning the entrustment of affairs (Article 11).


F. Newly insert criteria for imposing administrative fines (Article 13).

Specify and newly insert criteria for imposing administrative fines on any person who has violated the safety investment disclosure, investigation, and inspection system newly inserted in the Framework Act on Maritime Safety.
